Magistrate Binneh Kamara has on Tuesday 22nd November 2016 discharged a 12 year old boy who was alleged to have sexually penetrated a fourteen year old girl at the Magistrate Court No.1 on the Siaka Steven Street.
The boy was said to have been earlier refused bail by the Magistrate on the grounds that he was seen as a juvenile and he was therefore sent for age assessment to the Ministry of Health and Sanitation. He was also alleged to have been 16 years when the matter was first reported to the police.
Defending the accused’s age, Lawyer I.F Sawaneh said he should be discharged based on the fact of his age. He said the accused is below the age of criminal responsibility according to section 70 of the Child Right Act of 2007.
Magistrate Kamara said in consideration of the application made by the Defence Lawyer and pursuant to the medical report on the age assessment, he therefore discharged the accused pursuant to section 94 of the Criminal Procedures Act of 1965.
