Magistrate Hannah Bonnie of the Freetown Magistrates’ Court No.2 on Monday 2th October, 2017, remanded one Tamba Foday to the Male Correctional Centre for sexually penetrating 14 year -old child.

The accused was before the court on one count charge of Sexual Penetration of a Child Contrary to Section 19 of the Sexual Offences Act No. 12 of 2012.

The Particulars of offense stated that Tamba Foday on a date between January and July 2017 at 7 Lumley Road, sexually penetrated a child below eighteen to wit fourteen years.

While testifying in court, the child identified the accused as his neighbour and that on the night of the incident, she went to fetch some water at a nearby tap where she met him.

She said the accused told her to take his bucket which was already filled into his room very close to the tap.

“He followed me inside the room and closed the door. He forced me into the bed and I asked him what he wanted from me. He took the lace from his sneakers and braced my hands and mouth and inserted his penis into my virgina,” she testified

She added that after some time, she saw blood oozing from her but the accused told her not to disclose the incident to her parent, adding that he would harm her, if she does.

“On the next day, the accused sent me into his room again to collect a gas-light for him. He followed me and gave me a cup saying that I shouldn’t tell anyone about it. But when I went home my mother was not around. When she arrived the next morning she asked who owns the cup and I replied that the accused gave it to me and she was not pleased with it at all,” she said.

She told the court that when she returned from school on 15th June 2017, her mother suspected something unusual and asked her to remove her dress.

She told the court that she informed her mother that it was the accused that had sexual intercourse with her.

She said her mother I formed her father about the incident when he returned home from work, while they decided to make statement at the Lumley police station.

She testified that they were issued with a medical report and they went to the rainbow centre at the Princess Christian Maternity Hospital for medical treatment.

The accused was represented by lawyer M.Y. Kanu while Sergeant 678 Sheriff A prosecuted the matter.

The matter was adjourned to the 10th October 2017.
